To use the services, an authorized administrator of the client business connects the client's own messaging channels. For Facebook Messenger and Instagram, the client connects its own Facebook Pages and linked Instagram Business Accounts through the Facebook Login (OAuth) flow, granting Evolve Tech permission to send and receive messages on the client's behalf. The client is responsible for the confidentiality of its credentials and for activity under its account.
You acknowledge that you are solely responsible for maintaining the security of your account credentials. We recommend using strong passwords and enabling two-factor authentication. We will not be liable for unauthorized access due to your negligence or failure to secure your credentials.
We reserve the right to suspend or terminate your account if:

You retain ownership of all content you upload, create, or submit through our Services. By submitting User Content, you grant us a limited license to store, display, and use it to provide and improve our Services.

Our processing of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. With respect to end-user personal data, the client is the data controller and Evolve Tech acts as the data processor on the client's documented instructions.
Evolve Tech provides the platform and tools. You are fully responsible for ensuring your messaging campaigns comply with all applicable laws. We reserve the right to terminate service immediately if we detect illegal or abusive use.
By providing your phone number and consenting to receive SMS messages from Evolve Tech, you agree to receive support updates, billing reminders, appointment confirmations, product and service announcements, and other account-related notifications.
Message frequency may vary (typically 1–5 messages per month). Message and data rates may apply depending on your mobile carrier.
You can opt out of receiving SMS messages at any time by replying STOP to any SMS message you receive from us, or by updating your preferences in your account settings at evolvetech.pro/account. For help, reply HELP or contact support@evolvetech.pro.
Carriers are not responsible for delayed or undelivered messages.

You are responsible for all messages sent through our platform. You must maintain proof of consent, comply with TCPA, obtain 10DLC campaign registration, honor opt-out requests, and monitor for abuse.
Our Platform integrates with Meta's services to enable omnichannel customer communication. By using these integrations, you agree to comply with Meta's Platform Terms and Developer Policies.
Content shared by Instagram users is subject to Instagram's terms and copyright protections. Instagram user data may only be used to support direct messaging interactions.
While Evolve Tech provides the tools to integrate with Meta platforms, you are ultimately responsible for ensuring your messaging practices comply with Meta's Platform Terms, Developer Policies, and all applicable laws.

Disclaimers
OUR SERVICES ARE PROVIDED "AS-IS" AND "AS-AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, UNINTERRUPTED SERVICE, ACCURACY OF DATA, OR SECURITY AGAINST UNAUTHORIZED ACCESS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVOLVE TECH SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You may terminate your account at any time and disconnect your channels by revoking the OAuth authorization (for Meta channels) or removing the channel configuration. We may terminate your account immediately for Terms violations, illegal activity, or unpaid invoices beyond 30 days. Upon termination, your access ceases immediately and associated personal data is deleted or anonymized within 30 days as described in the Privacy Policy and Data Deletion Instructions, subject to records we are legally required to retain.
We may update these Terms at any time. Material changes will be communicated via email or posted on our website. Continued use after changes constitutes acceptance.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Both parties consent to the exclusive jurisdiction of the courts in Miami-Dade County, Florida.
The parties will first attempt to resolve any dispute informally by contacting info@evolvetech.pro. If a dispute cannot be resolved informally within thirty (30) days, it will be submitted to binding arbitration administered in Florida, except that either party may seek injunctive relief in court to protect its intellectual property or confidential information.
If any provision is found invalid, the remaining provisions remain in full force.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Evolve Tech. Where Meta Platform integrations are involved, Meta's Platform Terms prevail in case of conflict.
